1. Company Information

These Terms of Use ("Terms") govern access to and use of the website located at tagixo.com ("Site") and all related services, including software licenses and subscriptions ("Services"), provided by:

2. Acceptance of Terms

By accessing the Site or purchasing any Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are acting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not use the Site or Services.

3. Services

cCast S.r.l. Unipersonale develops and distributes software products, including Tagixo — a visual page builder for Laravel — and related plugins ("Software"). Services include:

One-time license purchases — a perpetual license to use a specific version of the Software.

Subscription plans — recurring access to the Software, including updates and premium support, billed on a monthly or annual basis.

4. Licenses

4.1 Grant of License

Upon completing a purchase, cCast grants you a non-exclusive, non-transferable, revocable license to install and use the Software solely for your own projects (personal or commercial), subject to the terms herein.

4.2 Restrictions

Except as expressly permitted by these Terms or by the specific plan purchased by you, you may not:

Redistribute, resell, sublicense, publish, share, lease, lend, transfer, or otherwise make the Software, any license key, or any part of the Software available to any third party as a standalone product, package, plugin, library, framework, service, or downloadable component.

Remove, obscure, disable, or alter any proprietary notices, copyright notices, watermarks, license keys, license checks, attribution, or other ownership or security mechanisms embedded in or associated with the Software.

Copy, reproduce, modify, adapt, translate, create derivative works from, decompile, disassemble, reverse engineer, inspect, extract, or otherwise attempt to derive the source code, structure, architecture, design, logic, features, workflows, user interface, or underlying ideas of the Software, except to the extent expressly permitted by applicable law.

Use the Software, the documentation, the distributed package, the license files, the source code, or any substantial part of them to create, develop, market, sell, distribute, or provide a standalone product, plugin, library, framework, tool, page builder, visual builder, website builder, template builder, CMS builder, or similar software product that is substantially similar to, derived from, or directly competitive with Tagixo.

Use the Software in any unlawful, fraudulent, abusive, harmful, or unauthorized manner, or in any way that infringes the rights of cCast S.r.l. or any third party.

The restrictions above do not prevent you from independently developing websites, web applications, SaaS applications, themes, plugins, templates, integrations, or other software for your own clients or business, provided that such development does not involve copying, extracting, reverse engineering, redistributing, reselling, sublicensing, publishing, sharing, or otherwise misusing the Software or any substantial part of it.

Any breach of this Section constitutes a material breach of these Terms and may result in the suspension or termination of your license, without prejudice to any other rights or remedies available to cCast S.r.l. under applicable law.

4.3 Number of Sites

The number of sites, domains, or installations permitted under a single license depends on the plan selected at purchase. The specific entitlements are detailed on the pricing page and in your order confirmation. Installing the Software beyond the permitted scope requires the purchase of an additional license or an upgrade to a higher plan.

4.4 Enterprise and SaaS use

If you purchase an Enterprise license, you may integrate and use the Software within your own SaaS applications, web applications, platforms, internal tools, client portals, or commercial projects, subject to the limits and entitlements of the Enterprise plan specified at the time of purchase.

Enterprise use may include making Tagixo-powered functionality available to your own end users as part of your application, provided that the Software is not distributed, resold, sublicensed, exposed, offered, or made available as a standalone product, standalone page builder, standalone visual builder, standalone plugin, library, framework, or competing software product.

You remain responsible for ensuring that your end users do not access, copy, extract, download, reverse engineer, redistribute, or otherwise misuse the Software, its source code, license files, internal APIs, or any substantial part of it.

Unless expressly agreed in writing with cCast S.r.l., an Enterprise license does not grant you the right to white-label, resell, sublicense, distribute, package, or commercially offer the Software itself as a separate product or service.

5. Subscriptions

5.1 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annual) from the date of your initial purchase. Prices are displayed at checkout and are exclusive of applicable taxes unless otherwise stated.

5.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of the current paid period; no partial refunds are issued for the remaining period.

5.3 Price Changes

We reserve the right to change subscription prices. We will notify you at least 30 days in advance of any price change via email. Continued use after the new price takes effect constitutes acceptance of the revised pricing.

6. Payments

All payments are processed securely through our payment provider. cCast does not store your full payment card details. By providing payment information, you authorize cCast to charge the applicable fees.

In case of a failed payment on a subscription, we will attempt to re-charge over a period of 7 days. If the payment cannot be collected, your subscription will be suspended and access to updates and premium features may be restricted.

7. Withdrawal Right, Activation and Refunds

7.1 Consumer Withdrawal Right

If you are a consumer residing in the European Union or in any other jurisdiction where a mandatory withdrawal right applies, you may have the right to withdraw from your purchase within fourteen (14) days from the date of purchase, without providing any reason, unless an exception provided by applicable law applies.

This withdrawal right applies to annual, lifetime, enterprise, and other paid licenses, provided that the license has not yet been activated and that access to the Software, license key, package, updates, private repository, or other digital content has not yet started.

7.2 Immediate Access and Loss of Withdrawal Right

Tagixo is supplied as digital content and/or a digital service. During the checkout process, you may be asked to expressly request immediate access to the Software before the expiry of the withdrawal period and to acknowledge that, once the supply of the digital content or digital service has begun, you lose your statutory right of withdrawal.

A license is considered activated when the license key is validated by our licensing systems, including, without limitation, during Composer installation, Composer update, package installation, package download, first authenticated access, or any other technical process that enables the use of the Software.

Once the license has been activated, access to the Software has started, or the Software has been downloaded, installed, or made available to you, you will no longer be entitled to withdraw from the purchase merely because you changed your mind, no longer need the Software, chose the wrong plan, no longer intend to use it, or found an alternative product.

7.3 Serious Technical Issues

The loss of the withdrawal right after activation does not affect any mandatory rights you may have under applicable consumer protection laws, including rights relating to defective, non-conforming, or unusable digital content or digital services.

After activation, a refund may be considered only in the event of serious and demonstrable technical issues that materially prevent the installation or use of the Software and that cannot be resolved by cCast S.r.l. within a reasonable time after you have provided sufficient information to investigate the issue.

Examples of serious technical issues may include critical bugs, installation failures, license validation failures, or major incompatibilities that prevent the Software from functioning substantially as described, provided that such issues are not caused by unsupported environments, incorrect configuration, third-party software, custom modifications, hosting limitations, lack of required technical dependencies, or misuse of the Software.

To request a refund for a serious technical issue, you must contact us at support@tagixo.com and provide all information reasonably necessary to reproduce and verify the issue, including error messages, logs, environment details, package versions, Laravel version, PHP version, installation steps, and any other relevant technical information.

7.4 Annual and Enterprise Licenses

Annual and Enterprise licenses are purchased for an initial annual term. After activation, the initial annual term is non-refundable, except in the case of serious and demonstrable technical issues as described above or where otherwise required by applicable law.

You may cancel automatic renewal at any time before the next renewal date. Cancellation prevents future renewals but does not automatically entitle you to a refund for the current active term.

If an Annual or Enterprise license renews and you request cancellation after the renewal payment has been charged, cCast S.r.l. may refund the unused portion of the renewed term on a pro-rata basis, calculated from the effective cancellation date, unless otherwise required by applicable law or agreed in writing.

7.5 Lifetime Licenses

Lifetime licenses are one-time purchases and do not renew automatically.

The same withdrawal and activation rules described above apply to Lifetime licenses. You may request withdrawal within fourteen (14) days from purchase only if the license has not been activated and access to the Software has not started.

Once a Lifetime license has been activated, downloaded, installed, or otherwise made available to you, the purchase is non-refundable, except in the case of serious and demonstrable technical issues as described above or where otherwise required by applicable law.

7.6 Refund Processing

Approved refunds will be processed using the original payment method where technically possible. Any refund may be reduced by amounts that are not refundable by third-party payment providers, taxes, currency conversion fees, bank fees, or other non-recoverable costs, unless otherwise required by applicable law.

Refunds do not grant you any right to continue using the Software. If a refund is issued, your license may be deactivated, and you must stop using, delete, and remove all copies of the Software, license files, and related materials from your systems, projects, repositories, and deployments.

7.7 No Limitation of Mandatory Rights

Nothing in this Section limits or excludes any mandatory rights that cannot be limited or excluded under applicable law.

8. Intellectual Property

The Software, Site content, trademarks, logos, and all related materials are the exclusive property of cCast S.r.l. Unipersonale or its licensors and are protected by Italian and international intellectual property laws.

Nothing in these Terms transfers any ownership rights to you. All rights not expressly granted herein are reserved.

9. Updates and Support

License holders receive updates for the major version purchased (e.g., v1.x) for the duration of their license term. Major version upgrades may require a new license or an upgrade fee.

Subscribers receive all updates (including major versions) and access to priority support for the duration of their active subscription.

Support is provided through the official support channels indicated on the Site. Support availability, response times and scope may vary depending on the purchased plan.

10. Disclaimer of Warranties

The Software and Services are provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

cCast does not warrant that the Software will be error-free, uninterrupted, or compatible with all third-party environments.

11. Limitation of Liability

To the fullest extent permitted by applicable law, cCast S.r.l. Unipersonale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising out of or related to your use of the Services or Software.

Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to cCast in the twelve (12) months preceding the claim.

12. Third-Party Services

The Software may integrate with or rely on third-party services (e.g., payment processors, CDNs). cCast is not responsible for the availability, accuracy, or practices of any third-party service. Use of third-party services is governed by their respective terms and privacy policies.

13. Termination

cCast reserves the right to suspend or terminate your access to the Services at any time, without notice, if you breach these Terms. Upon termination, your license to use the Software is immediately revoked, and you must cease all use and delete all copies in your possession.

Provisions that by their nature survive termination (including intellectual property, limitation of liability, and governing law) shall remain in effect.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Italy. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Catania, Italy.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Site at least 14 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
